Konsekuensi Hadirnya Peraturan Pemerintah Nomor 56 Tahun 2021 Tentang Pengelolaan Royalti Hak Cipta Lagu Dan/ Atau Musik Terhadap Pemungutan Royalti Lagu Dan/ Atau Musik

Abstrak

Selain memperhatikan penggunaan secara komersial di tempat layanan publik, perlindungan hak cipta khususnya terhadap ciptaan musik atau lagu juga menjadi masalah serius terkait perlindungan atas royalti suatu karya cipta lagu atau musik serta perlindungan hak-hak yang terkandung didalamnya. Adapun tujuan penelitian ini dilakukan untuk menganalisis tentang kedudukan hukum LMKN dan LMK dalam pelaksanaan pemungutan royalti lagu dan musik, menganalisis penerapan terhadap PP No. 56 Tahun 2021 setelah ditetapkan di Persatuan Radio Siaran Swasta Nasional Indonesia, serta menganalisis tentang penyelesaian terhadap sengketa pelaksanaan atas pemungutan dan pendistribusian royalti lagu dan musik di Indonesia. Hasil penelitian menunjukkan bahwa kedudukan hukum LMKN dan LMK dalam pelaksanaan pemungutan royalti lagu dan musik diatur dalam Permenkumham Nomor 36 Tahun 2018. Penetapan PP No. 56 Tahun 2021 di Persatuan Radio Siaran Swasta Indonesia pembayaran royalti menggunakan perhitungan dari hasil audit akuntan publik di tahun sebelumnya. Di Indonesia terdapat dua pola penyelesaian sengketa, yaitu the binding adjudicative procedure dan the non-binding adjudicative procedure. Disarankan pihak LMKN dan LMK melakukan tugas dan kewenangan masing-masing. Disarankan pemungutan dan pembayaran royalti di radio-radio swasta bisa seperti dulu yang langsung membayar secara akumulatif daripada di dapat dari hasil audit revenue. Di sarankan bagi pelaku bisnis di bidang hak cipta lagu dan musik disarankan selalu membuat perjanjian lisensi dan menentukan pilihan penyelesaian sengketa.

Abstract

In addition to paying attention to commercial use in public service places, copyright protection, especially against music or song creations, is also a serious problem related to the protection of royalties of a song or music copyright and the protection of rights contained therein. The purpose of this study was to analyze the legal position of LMKN and LMK in the implementation of song and music royalty collection, analyze the application of PP No. 56 of 2021 after it was established in the Indonesian National Private Broadcast Radio Association, and analyze the settlement of disputes over the implementation of the collection and distribution of song and music royalties in Indonesia. The results showed that the legal position of LMKN and LMK in the implementation of song and music royalty collection is regulated in Permenkumham Number 36 of 2018. Determination of PP No. 56 of 2021 at the Indonesian Private Broadcast Radio Association royalty payment using calculations from the audit results of public accountants in the previous year. In Indonesia there are two patterns of dispute resolution, namely the binding adjudicative procedure and the non-binding adjudicative procedure. It is recommended that the LMKN and LMK perform their respective duties and authorities. It is suggested that the collection and payment of royalties on private radios can be as it used to be directly paid accumulatively rather than obtained from the results of revenue audits. It is recommended for business people in the field of song and music copyright is advised to always make a license agreement and determine dispute resolution options.
